Property Market Showing Signs of Recovery

THE property market in Lincolnshire is beginning to show signs of recovery according to a leading county law firm.

Sills & Betteridge has seen a five per cent increase in property transactions it has dealt with for the first third of this year.

The market has seen some winners and losers according to the firm’s head of the residential property department Ian Baker, but the picture is generally encouraging.

The sale of homes below £250,000 – the threshold for three per cent Stamp Duty – are showing a steady increase across the county and buy to let property deals in Lincoln are showing signs of recovery.

However terrace houses are being replaced by new homes as the property of choice for young couples – driven by the lower maintenance and running costs.

The news comes in the wake of a survey by the Royal Institute of Chartered Surveyors unveiled last week (Oct 8) that forecast a strengthening of the property market at the end of the year.

The housing market survey predicted a pick-up in property transactions and a slowdown in price falls, both of which will lead to a stronger housing market at the end of 2012.

Government initiatives to boost the property market, including the NewBuy initiative that aims to increase the number of first-time buyers, have helped boost the prospects for mortgage availability, meaning confidence among surveyors in future sales is at its highest peak since May 2010, said the Institute.
Sills & Betteridge, which has eight offices around the county, is well placed to see fluctuations in the market as it handles hundreds of property transactions a year.

The firm was recently awarded membership of the Conveyancing Quality Scheme – one of only a few solicitors in the county – after a rigorous assessment by the Law Society.

Many banks and building societies only allow law firms with the CQS scheme to undertake conveyancing and act for the lenders.

“The main sector experiencing growth is properties with a value of up to £250,000. Above that, of course, Stamp Duty rises to three per cent of the full purchase price and that seems to be a having an effect on the saleability of properties above that price,” said Mr Baker.

“Terraced housing doesn’t seem to be enjoying quite the same signs of recovery. I think this is largely because younger couples these days would prefer to buy a new property rather than starting with a terrace. 

“Certainly we are finding that landlords are coming back into the market because the rental income is better than returns from other forms of investment.”
Leading Lincoln estate agent Starkey&Brown said signs of a market recovery were emerging.

"Our company has seen a year-on-year increase on house sales of 63% when comparing 2011 to 2012. Indeed throughout 2012 there have been gradual signs of a good strong recovery in the housing market,” said director Michael Brown said:

"And although the bulk of activity has been towards the lower end of the market, this has enabled many who are selling their first home to go on and buy a larger property, thus triggering house sales 'further up the ladder'.

ts of the construction industry from hands on tasks to banking and finance.

We at Sills & Betteridge have put together a group to run through a mock trial relating to Health and Safety regulations.

Andrew Goldsborough is heading the team with colleagues Leanne Maund, Carena Fullerton, Stewart Lough and Dale Brownless.

In order to get into the spirit of things, Stewart tested out the judge's outfit ready for the event!

Sills & Betteridge help Mother from Lincoln win Cosmetic Surgery Claim

A MOTHER from Lincoln has won a pay-out of more than £25,000 after her cosmetic surgery went wrong.

The 27-year-old had two breast operations carried out by a Harley Street plastic surgeon in 2007 and 2008.

The initial operation left her with disfigured breasts and despite a further corrective operation she was left with different size breasts, unsightly bulges and considerable pain.

The compensation was won by Lincoln lawyers Sills & Betteridge in an out-of-court settlement.

Initially the claim was disputed but when Sills launched court proceedings the case was settled without admission of liability.

Their client now has to have a third operation to correct the problems.

Earlier this year the British government ordered a review of the cosmetic surgery industry, led by NHS medical director Sir Bruce Keogh.

He will examine whether there needs to be more regulation, how complaints are dealt with, and whether better clinical governance is needed.

The move came in the wake of the scandal over breast implants when it was revealed a French company had manufactured breast implants using industrial silicon rather than medical grade material.

“We were delighted to have won a substantial amount for our client. She has suffered both physically and mentally as a result of these operations and the compensation has allowed her to have corrective surgery,” said Stephen Wilson, deputy senior partner and head of the Accident Claims Department at Sills.

“Amidst the current wave of concerns and problems in the cosmetic surgery industry we are receiving more and more enquiries.

“We would urge anyone who is worried or unhappy about their surgery to seek legal advice.”

The mother, who did not want to be named, said: “It was a terrible ordeal and, though the money can’t make it right, it has paid for another operation.

“I was so shaken and upset by the whole saga but glad I took legal advice. I would urge others not to suffer in silence but to make sure they seek recompense."

S&B's Karla Wright dancing for St Barnabas Hospice Trust (Lincolnshire)!

Sills & Betteridge's Karla Wright, of the Conveyancing team, and her husband are participating in the St Barnabas Strictly Ballroom event - a Strictly Come Dancing-esque dance contest.

For 10 weeks now, they have been training to learn the Jive and Tango to show to the world at the grand finale on Sunday 11th November 2012. It will be held at the LPAC building on the Lincoln Uni campus.

Sills & Betteridge's Conveyancing team become members of the Conveyancing Quality Scheme

A LINCOLN legal firm has gained a mark of quality from the Law Society for residential property work.

Sills & Betteridge joined only a few Firms of solicitors in the county as members the Conveyancing Quality Scheme after rigorous assessment by the Society.

The scheme was launched by the Society last year to reinforce consistency of standards throughout the conveyancing process, reduce the risk of fraud, and give consumers peace of mind when it comes to home buying and selling.

Many banks and building societies only allow law firms with the CQS scheme to undertake conveyancing and act for the lenders.

To secure membership to the CQS firms must adhere to a strict set of good practice standards and procedures and key staff must be vetted and trained.

Firms must renew their membership each year.

Recently Santander changed the terms of its residential conveyancing panel to require all existing members to gain the CQS accreditation. In August HSBC allowed, for the first time, all firms with CQS to act on its behalf.

“Buying a house or property is a huge undertaking for families or businesses and in most cases will be the biggest and most important transaction of their lives,” said Ian Baker, partner and head of the residential property department at Sills & Betteridge.

“Consumers, mortgage lenders and others involved in the process need to be sure they are dealing with a firm that can be trusted to maintain the highest standards of integrity and carry out the transaction in a professional and efficient way.

“The process to secure membership is rigorous and challenging but we feel it is important because It establishes a level of credibility with those stakeholders.”

The CQS membership is based upon:

•           the integrity of the Senior Responsible Officer and other key conveyancing staff

•           the firm's adherence to good practice management standards

•           adherence to prudent and efficient conveyancing procedures through the scheme protocol

This scheme creates a trusted community which will deter fraud - year on year we will drive up standards.

Sills & Betteridge revisit Nettleham Woodland Trust Wetland

In the Spring of 2011, Sills & Betteridge donated £500 towards the Nettleham Woodland Trust to support local projects in Lincolnshire. The sponsorship was used to help in planting 18 different species in the wetland at Monks Wood, Dunholme near Lincoln.

It's a year and a bit later and we revisted the site to see the trees had grown well!

On Saturday 28th and Sunday 29th July 2012, Heckington Show was bustling with people out for the day visiting the various stands. We saw Saturday with fabulous weather enough for an ice cream and a tan.

Katie from Flutterby Parties helped us out on both days with free face painting and balloon shaping for the kids. She was amazing!

On the Sunday, the Show Jumping event was brilliant despite the weather being touch and go. Rachel Maclean, Partner at S&B and lover of all things equine, presented a cup to the winner of the Halsall Electrical National Grades B&C Handicap Championship Qualifier (sponsored by Sills & Betteridge Solicitors).

Finally, to round off the weekend, the organisers of the Heckington Show broke out the monster trucks!

We'd like to give a huge thank you to those that visited us during the weekend and we hope you enjoyed it as much as we did!

Here at Sills & Betteridge, we would like you to have a fun and unforgettable summer.

When the weather is perfect, you might go to the beach with family and friends.

But there is a chance things may not go to plan.

Here is a little advice from the Coastguard:

  • -  Inflatables can be dangerous and can easily be blown out to sea. If this happens, stay
       with the inflatable as this will keep you afloat.
    -  Wave your arms and make as much noise as you can to attract attention.

If you find that someone's in trouble, tell a lifeguard or ring 999 and ask for the Coastguard.

With a new kit and a new squad members, the ‘Sills Sabres’ went into last night’s ‘Lincoln Professionals’ Football Tournament’ with renewed optimism after last year’s early exit.  Having been drawn into what could only be described as ‘The Group of Death’ alongside local footballing heavyweights Lloyds and HSBC, it was clear that a good start was needed against fellow lawyers Bridge McFarland.  In spite of a spirited performance, The Sabres contrived to lose a game which they should have won – final score 2-1, Simon scoring what turned out to be a consolation goal.  Ironically, it was ‘The Sabres’ lack of sharpness in front of goal that cost them.

Next up were Lloyds Bank – having watched their opening performance from the stands, the feeling amongst the Sills squad was that a number of the Lloyds’ team might have been ‘bussed’ in from branches around the country! Sills’ would clearly need to ‘up their game’ to match these guys. At 1-0 down with a few minutes to go Sills pressed forward in search of an equaliser. Unfortunately, the ‘rub of the green’ went with Lloyds and two break away goals in the dying seconds gave a final score of 3-0.

The final group game against HSBC was again a tight and tense affair – an early goal from the Bank was cancelled out when Simon (the only member of the tram to bring his shooting boots!) scored his second goal of the tournament. With time running out both teams went looking for a ‘winner’ – in the end the game was settled by a late goal from HSBC.

Sadly ‘The Sabres’ didn’t trouble the ‘trophy engravers’ again and went home - for the second year running! - on the first flight. In spite of the lack of success on the pitch the evening was enjoyed by the whole squad – The Sabres will be back again next year!
